Terms of Service
Welcome to Peace Place! These Terms of Service ("Terms") govern your access to and use of the Peace Place website, mobile applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service. 1\. Our Mission Peace Place is dedicated to fostering open, respectful dialogue and the free exchange of ideas, provided such speech remains peaceful and non-violent. We believe in the power of diverse perspectives and aim to create a platform where individuals can express themselves without fear of censorship, as long as their expression adheres to our core principles of peacefulness and non-incitement to violence. 2\. Acceptance of Terms By creating an account, accessing, or using the Service, you confirm that you can form a binding contract with Peace Place and are not a person barred from receiving services under the laws of the United States or other applicable jurisdiction. If you are accepting these Terms on behalf of an entity, you represent and warrant that you are authorized to do so. 3\. Content Principles: Free Speech & Peaceful Conduct a. Free Speech, Broadly Defined: We uphold the principle of free speech. This means you are generally free to express your opinions, beliefs, and ideas, even if they are unpopular or controversial. We will not remove content solely because it expresses a particular political, religious, or philosophical viewpoint. b. Commitment to Peaceful Conduct: While we champion free speech, we have zero tolerance for content or behavior that: \* Incites Violence: Directly or indirectly encourages, promotes, or glorifies violence against any individual, group, or property. This includes calls to action for violence, threats of violence, and the promotion of terrorist or extremist organizations. \* Promotes Illegal Activities: Encourages or facilitates illegal activities, including but not limited to drug use, human trafficking, or other criminal acts. \* Harassment and Bullying: Engages in severe or persistent harassment, bullying, doxing (publishing private information without consent), or stalking of other users. While robust debate is encouraged, personal attacks intended to intimidate or silence others are not. \* Hate Speech: Promotes hatred, discrimination, or violence against individuals or groups based on attributes such as race, ethnicity, religion, gender, sexual orientation, disability, or national origin. We recognize the nuanced nature of hate speech and will strive to apply this principle carefully. \* Child Exploitation: In any way exploits, abuses, or endangers children. This includes child pornography or content that solicits sexual acts with minors. \* Spam and Malicious Content: Distributes spam, malware, viruses, or other harmful content designed to disrupt, damage, or gain unauthorized access to our Service or other users' systems. \* Impersonation: Impersonates any person or entity, or falsely states or otherwise misrepresents your affiliation with a person or entity. c. Moderation Philosophy: In cases where content is reported or identified as potentially violating these peaceful conduct principles, Peace Place will review it. Our goal is to protect the integrity of the platform as a space for free, yet peaceful, expression. Decisions will be made on a case-by-case basis, with an emphasis on protecting peaceful discourse while also respecting individual expression. Content that clearly violates the peaceful conduct principles will be removed. Repeat offenders may have their accounts suspended or terminated. 4\. User Accounts a. Account Creation: You may need to create an account to access certain features of the Service. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. b. Account Security: You are responsible for safeguarding your password and for any activities or actions under your account. Peace Place cannot and will not be liable for any loss or damage arising from your failure to maintain the security of your account and password. c. One Account Per User: Users are generally permitted to maintain only one active account. 5\. User Conduct You agree not to use the Service to: Violate any applicable law or regulation. Infringe upon the rights of others, including copyright, trademark, privacy, or publicity rights. Disrupt or interfere with the security or accessibility of the Service, or otherwise cause harm to the Service, system resources, accounts, passwords, servers, or networks connected to or accessible through the Service. Attempt to gain unauthorized access to the Service or computer systems or networks connected to the Service. 6\. Intellectual Property a. Your Content: You retain all rights in and to the content you create, post, or share on or through the Service. By posting content, you grant Peace Place a non-exclusive, royalty-free, worldwide, transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display such content on and through the Service. b. Peace Place Content: All intellectual property rights in the Service itself (excluding user-generated content), including but not limited to software, design, text, graphics, logos, and trademarks, are owned by Peace Place or its licensors. 7\. Reporting Violations If you encounter content or behavior that you believe violates these Terms, particularly the peaceful conduct principles, please report it to us using the designated reporting tools on the Service. We will review reports and take appropriate action as deemed necessary. 8\. Disclaimers THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Peace Place DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. 9\. Limitation of Liability TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Peace Place, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. 10\. Indemnification You agree to defend, indemnify, and hold harmless Peace Place and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms. 11\. Termination We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. 12\. Changes to Terms We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. 13\. Governing Law These Terms shall be governed and construed in accordance with the laws of Arizona, without regard to its conflict of law provisions. 14\. Severability If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. 15\. Entire Agreement These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service. 16\.
